1. Acceptance of terms

By accessing or using SMB Insights at smb-insight.com ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you and the operator of SMB Insights ("we", "us", "our"). The Service is currently operated by an individual, not an incorporated company. Your use of the Service is also governed by our Privacy Policy.

2. Description of service

SMB Insights is a web application that:

• Aggregates news articles from third-party RSS sources
• Scores and filters articles based on relevance signals
• Uses Claude AI (Anthropic) to generate business hypotheses and insights from selected articles
• Lets you track, organize and act on generated insights

The Service is provided "as is" and we may modify, suspend or discontinue it at any time.

3. Account registration

To use SMB Insights you must sign in with a valid Google account. By signing in you:

• Confirm you are at least 16 years old
• Agree to provide accurate information
• Are responsible for the security of your account
• Accept responsibility for all activity under your account

4. Acceptable use

You agree to use the Service only for lawful purposes. You must not:

• Generate content that is illegal, harmful or violates third-party rights
• Reverse-engineer, scrape or abuse the Service's API
• Use bots or scripts that harm the Service's performance
• Share your account credentials
• Use the Service for competitive intelligence against SMB Insights itself
• Circumvent security measures or access controls

5. Insights are not advice or a recommendation to act

This is important. SMB Insights uses an AI model (Claude) to generate business hypotheses from public news. You acknowledge and agree that:

• Insights are informational only. They are starting points for your own thinking — not a recommendation, instruction or call to act, and not business, legal, financial, investment or tax advice.
• AI output can be wrong. Insights may be inaccurate, incomplete, outdated or unsuitable for your situation. We do not verify them.
• You decide. Any decision to pursue, build, invest in or act on an insight is entirely your own, made at your own risk and judgement.
• We are not responsible for outcomes. We are not responsible for how you implement an insight or for any result, loss or damage arising from acting on one.

6. Third-party content

The Service aggregates news from third-party sources. We do not own or control this content and are not responsible for its accuracy, legality or appropriateness. External links are provided for convenience only.

7. Intellectual property

The SMB Insights application, its code, design and branding are our intellectual property. You may not copy, reproduce or redistribute any part of the Service without our written permission.

You retain ownership of any data you input. By using the Service you grant us a limited license to process that data solely to provide the Service to you.

8. Credits, payments and refunds

SMB Insights runs on a pay-as-you-go credit model — no subscription, no automatic charges.

• 1 credit = 1 operation (generating insights, or working through a single insight).
• You buy credits in packages. Current packages and prices are shown in your account.
• Credits do not expire.
• Collecting news and scoring articles is free; credits are spent only on AI operations.
• Credits are non-refundable. Purchased credits cannot be refunded or exchanged for money, except where a refund is required by applicable mandatory consumer law.
• If an operation fails for a technical reason on our side, the credit for that operation is automatically returned to your balance.

Payments are processed by Stripe; by purchasing you also accept Stripe's terms. We may change prices at any time; existing credit balances keep their value.

9. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Limitation of liability

To the fullest extent permitted by applicable law:

• We are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data or business opportunities.
• We are not liable for any decision you make, or any outcome, loss or damage resulting from acting on an insight or any AI-generated content (see section 5).
• Our total aggregate liability for any claim arising from your use of the Service shall not exceed the total amount you paid us in the 12 months before the claim.

Some jurisdictions do not allow certain limitations; in that case the limitations apply only to the extent permitted, and mandatory consumer rights remain unaffected.

11. Indemnification

You agree to indemnify and hold harmless the operator of SMB Insights from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. You may stop using the Service at any time. To delete your account and data, contact us (see Contact below).

13. Governing law and disputes

These Terms are governed by the applicable law of your place of residence to the extent mandatory consumer-protection rules apply, and otherwise by general principles of contract law. We aim to resolve any dispute through good-faith negotiation first; please contact us before taking formal steps. Nothing here deprives a consumer of the protection of mandatory provisions of the law of their country of residence.

14. Changes to terms

We may modify these Terms at any time. We will signal material changes by updating the "Last updated" date and, for significant changes, by notifying your registered email. Continued use after changes constitutes acceptance.
